Purchasing, Pickup, and Delivery of Wine and/or Spirits (Conditions of Sale)

Your acceptance of these Conditions of Sale will be acknowledged by the creation of an online account at artofwineinc.com, Art of Wine, Inc (Art of Wine) - for all orders placed on our website. By accepting these Retail Conditions of Sale, you are accepting them for the duration of your buying relationship with Art of Wine. These Conditions of Sale will also apply to any retail purchases you make over the phone or through email should you choose to these methods of purchase. Art of Wine reserves the right to make changes to this policy at any time. By placing an order for wine and/or spirits, the Buyer warrants that they are at least 21 years of age, and that the recipient of any delivery of the wine and/or spirits will be at least 21 years of age. Except for orders described in the next paragraph, title to and ownership of wine and/or spirits passes from Art of Wine (Seller) to the Customer (Purchaser), in New York, and the Purchaser takes all responsibility for the product being transported once the order has been picked up by the delivery service(s) from Art of Wine to the Purchaser’s selected destination. The Purchaser may pick up the product at Seller’s location or make independent delivery arrangements. Sales tax will be applied based on the Seller’s location. The Seller makes no representation as to the legal rights of anyone to deliver or import any alcoholic beverages or other goods into any state. The Purchaser warrants he or she is solely responsible for the transport of the purchased products and for determining the legality and the tax/duty consequences of bringing the products to the buyer’s chosen destination. All taxes, duties, and/or tariffs imposed at the time of delivery are the sole responsibility of the Purchaser and must be remitted prior to the release of the wines and/or spirits.

If Art of Wine, for any reason, is unable to fulfill its obligations to the Purchaser, Art of Wine's sole obligation and the Purchaser's sole recourse shall be a refund of the purchase price.

Art of Wine makes no warranty, expressed or implied, about the wine and/or spirits being sold except that Art of Wine is conveying clear title to the wine and, to Art of Wine's knowledge, the wine and/or spirits is what its label describes it to be. Specifically, because wine and/or spirits by its nature is subject to change in the bottle over time, Art of Wine makes no warranty or guaranty of the quality or drinkability of any wine and/or spirits sold.

THE WARRANTIES SPECIFIED IN THIS CONTRACT ARE IN LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

This contract is entered into in New York and shall be enforceable there under the laws of that State. Art of Wine prices are good while supplies last. Discount and/or promotions cannot be applied to previous purchases, futures or gift orders. Art of Wine reserves the right to correct errors on pricing and to limit quantities ordered. In the case of an incorrect price the Purchaser will be contacted to accept or reject the corrected price. Prices are subject to change without notice. Art of Wine is not responsible for typographical errors. All orders are subject to confirmation by Art of Wine. Order processing time is contingent upon payment authorization and does not include weekends or holidays. Please allow up to 48 hours for our delivery team to coordinate your order upon completion of payment. Upon review of your order our customer service team may contact you to discuss your order. By submitting your order for confirmation, you hereby represent to Art of Wine that you understand these terms and conditions and agree to abide by them in connection with this transaction. The placing and accepting of an order shall form a contract on these terms, conditional upon confirmation of the order by Art of Wine, which may be evidenced by the delivery of an invoice. Payment is due upon order confirmation. Payment may be made by cash or credit card. Art of Wine will not transfer title to any goods until full payment is received. By providing your credit card number, you authorize Art of Wine to charge your credit card for the costs associated with your wine and/or spirits purchase as described in these Terms and Conditions (for example, for purchase price, tax, redelivery, other shipping-delivery fees/handling charges). The Art of Wine charge will appear on your inovice immediately following placement of your order. By authorizing Art of Wine to charge your credit card, you acknowledge and agree to be financially responsible for any and all charges incurred in connection with your transaction. You hereby warrant and represent that you have the authority to legally bind the cardholder as set forth herein. 

Order Processing

Our web site is monitored Monday through Friday from 10:00 a.m. to 5 p.m. EST. It takes approximately up to 48 hours to process your order, and be prepared for In-Store or Curbsinde Pickup. If you have a need for delivery by a certain date or need rush service, please be sure to contact us at 914-769-0206. We will make every effort to accommodate you. Special Ordered product(s) cannot be canceled or returned for credit.

All payments for orders are processed immediately after verification of the order.

Special Orders

Special Orders or a special ordered product(s) are items that have been acquired specifically by Art of Wine at the client’s request, as they are not a regularly stocked item at the time of purchase. Special Ordered product(s) cannot be canceled or returned. Special ordered items include special size requests, products not stocked by Art of Wine, pre-arrivals or futures offers.

Product Images

Sometimes images representing a product may not be an exact image of the item being sold as the producer of a product may change the look or package of its product from time to time. This may include or exclude a box, inclusion of value added item such as glasses, ice molds etc. Art of Wine makes an effort to keep product images updated to more accurately portray the item(s) on our website.
